Tobacco industry executives and analysts are sounding alarms about a surge of unregulated nicotine pouches entering the U.S. that is chipping away at regulated products.

The 4th generation of devices, known as ‘Pods’, has been driven by advances in electronic atomization technology3,7,8,9.

Youth vaping has declined from all-time highs in recent years, but 2.8 million middle and high school students still use it, according to federal survey data. These findings can reflect general openness to nicotine use, indicated by a previous study showing considerable overlap between susceptibility types [24]. But switching to e-cigarettes still exposes users to potentially serious ongoing health risks. In addition to these laws, e-cigarettes are prohibited from being used in child care facilities, and people purchasing tobacco products have to pay a 15 percent tax. While not all the effects of smoking are immediate, the complications and damage can last for years. The good news is that quitting smoking can reduce many risk factors for the conditions and diseases below. For a long time, e-cigarettes and other electronic aerosolizers weren’t regulated by the Food and Drug Administration (FDA). They only came under the purview of the FDA in 2016, after they had been on the market for nearly a decade.
Similar results emerged when they excluded individual states with statewide policies from the analysis, showing that no one state was driving this effect. Bans on all vapes, including both flavored and unflavored, also resulted in more cigarette sales. The long-term health effects of electronic cigarettes (e-cigarettes) are not fully understood, but the science indicates they are not a safe alternative to smoking. Most are noncombustible which includes a battery, a heating element, and a liquid compartment, usually containing addictive nicotine, that is added to the e-liquid or included in the device. The heating element aerosolizes the liquid for the inhalation of the liquid nicotine or other contents.
The Centers for Disease Control and Prevention (CDC) report that vaping nicotine can permanently affect brain development in people under the age of 25. The researchers concluded that vaping with and without nicotine disrupts typical lung function in otherwise healthy people. The researchers reported a number of adverse effects on both types of cells, including toxicity, oxidation, and inflammation. However, these results aren’t necessarily generalizable to vaping in real life. A 2019 study assessed data from a nationwide survey of nearly 450,000 participants and found no significant association between e-cigarette use and heart disease. The authors also described moderate evidence suggesting that taking a puff from an e-cigarette increases blood pressure.

Among people who were currently using e‑cigarettes, the proportion of people who used them daily remained stable from 2016 (42%) to 2019 (42%), then increased in 2022–2023 (49%). While more males than females used e‑cigarettes daily, the change among females was much greater than among males, rising from 36% in 2019 to 51% in 2022–2023. This corresponds to a fourfold increase in the number of females using e‑cigarettes daily, from approximately 70,000 to 300,000 (Figure 2).

The survey also found that Minnesota youth are ill-informed about the health risks of e-cigarettes with 76.1% of 11th graders saying there is either no, slight, or a moderate risk to using e-cigarettes. 11th grade students responding to the student survey said that the top ways they got e-cigarettes included getting products from friends (72.3%), getting products at a vape shop (14.0%), and on the Internet (9.6%). Among 8th grade students, e-cigarette use nearly doubled from 2016 to 2019, and one in four 11th graders now use e-cigarettes. From early 2024, stronger controls on the importation, manufacture, advertising, supply and commercial possession of all e‑cigarette devices and components (with and without nicotine) are being implemented by the Australian Government. These regulatory changes are being implemented by the Federal Government in stages during 2024 in partnership with State and Territory Governments (TGA 2023). Researchers said that the results show e-cigarettes may confer as much as or potentially even more harm to users and especially patients at risk for vascular disease. District Court for the District of Columbia ruled that e-cigarettes did not meet the criteria for drug-delivery devices and therefore were exempt from regulation under the FFDCA. Reports in 2018 of increased e-cigarette use among adolescents and teenagers in the United States prompted the FDA to identify strategies for combating e-cigarette use by minors. Altria’s data showed Njoy e-cigarettes helped smokers reduce their exposure to the harmful chemicals in traditional cigarettes, the FDA said. The agency stressed the products are neither safe nor "FDA approved," and that people who don’t smoke shouldn’t use them. The FDA regulates the manufacture, distribution, and marketing of tobacco products, such as cigarettes, cigars, and e-cigarettes (sometimes called "vapes").
